Min Firmware — End User License Agreement (EULA)
Mingo Systems — Min firmware for RP2350 devices
This End User License Agreement (“Agreement”) is a legal agreement between you (“you”, “User”) and Mingo Systems (“Mingo”, “we”, “us”) governing your use of the Min firmware, including the firmware binary image, the embedded web-based editor it serves, license keys, and any updates we provide (together, the “Software”).
By downloading, installing, or using the Software you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the Software.
1. Definitions
- “Device” — a supported RP2350-based board (such as the Raspberry Pi Pico 2 W or Pimoroni Pico Plus 2 W) owned or controlled by you.
- “Official Channel” — distribution points operated by Mingo, currently https://firmware.mingo.systems/ and https://mingo.systems/.
- “License Key” — a device-bound token issued by Mingo that unlocks optional paid features of the Software (“Plus features”).
- “User Content” — Pd patches, samples, settings, and other data you create, load, or store on a Device.
2. License grant
Subject to this Agreement, Mingo grants you a personal, worldwide, non-exclusive, non-transferable, revocable license to:
- download the Software from an Official Channel;
- install and run the Software on Devices you own or control, including for commercial music-making and performance;
- keep copies of the downloaded firmware image for backup and re-flashing of your own Devices.
The Software is licensed, not sold. Mingo and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights, except as expressly granted here and except for the open-source components described in Section 5.
3. Restrictions
Except as expressly permitted by Section 5 (open-source components) or by applicable law that cannot be contractually waived, you must not:
- redistribute the Software — including uploading, mirroring, bundling, reselling, or otherwise making the firmware image or License Keys available to any third party, whether free or for payment. Third parties must obtain the Software from an Official Channel;
- reverse engineer, decompile, disassemble, or extract the source code of the Software, or attempt to do so;
- modify the Software or create derivative works of it, or distribute any modified version of it;
- circumvent or attempt to circumvent any technical protection measure in the Software, including firmware signature verification, License Key verification, or feature entitlements — or make, distribute, or use tools whose purpose is such circumvention;
- share, sell, sublicense, or transfer License Keys, or use a License Key on any device other than the Device it was issued for;
- remove or obscure any copyright, trademark, or attribution notice in the Software; or
- use the Mingo Systems or Min names or logos to endorse or promote any product without prior written permission.
Statutory rights. Nothing in this Agreement limits rights you may have under applicable law that cannot be excluded by contract, including rights under UK and EU law to observe, study, and test the functioning of a program and, in narrow circumstances, to decompile it solely to achieve interoperability where the necessary information is not otherwise available. If you believe you need interoperability information, contact us first — we will usually just provide it.
4. License Keys and Plus features
Plus features are unlocked by a License Key purchased from Mingo. Each key is cryptographically bound to a single Device and is non-transferable. Keys work offline and do not expire, but remain subject to this Agreement; a key obtained by fraud, chargeback, or circumvention may be revoked in firmware updates.
5. Open-source components
The Software incorporates open-source software — including Pure Data (Miller Puckette and others), the cyclone and ELSE external libraries, the Raspberry Pi Pico SDK, lwIP, BTstack, TinyUSB, micro-ecc, and the cyw43 driver — each under its own license. The complete list and license texts are in Third-Party Licenses, which is also available from the Official Channels.
Nothing in this Agreement restricts any rights granted to you by those open-source licenses in the components themselves. The originals are freely available from their upstream projects. The restrictions in Section 3 apply to the Software as a combined, compiled, and signed work and to Mingo’s own proprietary code within it.
6. User Content
Your patches, samples, and settings are yours. Mingo claims no ownership of User Content, and this Agreement places no restriction on your right to use, share, or sell patches you create with the Software.
7. Updates
Mingo may provide firmware updates through Official Channels. Updates are covered by this Agreement (or a successor agreement provided with the update) and may add, change, or remove features. Installing updates is optional but recommended; some fixes may only be provided in the latest version.
8. Support and maintenance
Mingo is under no obligation to provide any support, maintenance, technical assistance, training, error correction, bug fixes, patches, updates, upgrades, or new versions of the Software. Any support Mingo chooses to provide — through documentation, community channels, email, or otherwise — is voluntary, provided “as is”, may be limited, suspended, or discontinued at any time without notice, and creates no obligation to provide further or continuing support, or continued compatibility with any hardware, host software, or service. License Keys unlock Plus features; they do not purchase support or maintenance. Nothing in this section limits warranties or remedies that applicable consumer law grants you and that cannot be excluded.
9. Termination
This Agreement is effective until terminated. It terminates automatically if you materially breach it. On termination you must stop using the Software and delete your copies of the firmware image; Sections 5, 6, 8, 10, 11, 12, and 13 survive. Termination does not affect your statutory rights or your rights in the open-source components under their own licenses.
10. Disclaimer of warranty
To the maximum extent permitted by law, the Software is provided “as is” without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Mingo does not warrant that the Software will be uninterrupted or error-free. Nothing in this section limits warranties or remedies that applicable consumer law grants you and that cannot be excluded.
11. Limitation of liability
To the maximum extent permitted by applicable law, Mingo accepts no liability whatsoever arising out of or in connection with the Software or this Agreement:
- You use the Software entirely at your own risk. Mingo shall not be liable for any loss or damage of any kind — direct, indirect, incidental, special, consequential, or exemplary — including, without limitation, loss of or corruption of data, patches, samples, or settings; loss of profits, revenue, or business; business interruption; damage to Devices; or damage to connected audio equipment, speakers, or hearing (the Software generates audio and may produce sudden, loud, or full-scale output); whether arising in contract, tort (including negligence), statute, or otherwise, and even if Mingo has been advised of the possibility of such loss or damage.
- If and to the extent any liability nonetheless arises and cannot lawfully be excluded, Mingo’s total aggregate liability under this Agreement shall not exceed the amount you paid Mingo for the Software and License Keys in the twelve months preceding the claim. The firmware itself is provided free of charge; where you have paid Mingo nothing, that amount is zero.
- Nothing in this Agreement excludes or limits liability that applicable law does not permit to be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Export controls and sanctions
The Software may be subject to export control and sanctions laws and regulations of the United Kingdom, the European Union, the United States (including the U.S. Export Administration Regulations and sanctions administered by the Office of Foreign Assets Control), and other jurisdictions. You must not download, access, use, export, re-export, or transfer the Software except in full compliance with all applicable export control and sanctions laws. In particular, you represent and agree that you:
- are not located in, ordinarily resident in, or acting on behalf of a person in any country or region subject to a comprehensive embargo or sanctions (at the date of this Agreement including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine);
- are not named on, or owned or controlled by any person named on, any applicable denied-parties list, including the UK Sanctions List, the EU Consolidated List, and the U.S. Specially Designated Nationals, Denied Persons, and Entity Lists; and
- will not use the Software for any end use prohibited by applicable export control law, including the development of weapons of mass destruction or prohibited military end uses.
You are responsible for compliance with the laws of your own jurisdiction. This Agreement, and your license under it, terminate automatically if any of the above ceases to be true.
13. General
- Governing law and venue: this Agreement is governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts — except that consumers retain the protection of, and the right to bring proceedings under, the mandatory laws of their country of residence.
- Severability: if any provision is held unenforceable, the remainder stays in effect.
- Entire agreement: this Agreement is the entire agreement regarding the Software and supersedes prior discussions.
